Ice Cream Standoff: Rocky Road In Mamaroneck MAMARONECK, N.Y. -- In the standoff between the Village of Mamaroneck and Ralph's Italian Ices and Ice Cream, so far Ralph's is winning. Well, kind of -- if you call getting a $250 violation from the village for operating without a certificate of occupation, winning. "I'm open and serving people and the Village of Mamaroneck doesn't know what they are doing," owner Scott Rosenberg told the Daily Voice Friday afternoon. Assistant Village Manager Daniel Sarnoff said late Friday: "We are not commenting on the advice of our counsel." Rosenberg is just happy to be open and plans to continue to open and receive daily violations until village officials take some kind of stand. "I'm not going anywhere," he said. "It will be kind of interesting to see what happens. Will people come and protest again? What will the village do?" The whole mess started just shortly after Rosenberg opened when the Village Zoning Board of Appeals decided they had provided him with the wrong kind of permit; a retail instead of food permit. Then the neighbors started complaining about the noise and traffic. The board of appeals decided to revoke his license and told him he would have to close. Thursday was supposed to be his last day. But a couple hundred people showed up Thursday night to protest the closing and that only fueled Rosenberg's desire to keep open his "little" business. Rosenberg claims the village is costing him a half-million dollars by making him close. He also said he has jumped thru all the hoops to make changes they requested for him to stay open. https://www.facebook.com/groups/747730981915736/permalink/1516878511667642/ Ralph's Famous Italian Ices and Ice Cream shop in Mamaroneck faces a rocky road after local government officials ordered the owner to close down, but Scott Rosenberg opened his doors Friday in defiance. Crowds gathered outside the business on East Boston Post Road the night before to protest the zoning board's decision. Neighbors had complained about crowd noise, trash and safety concerns. The Zoning Board of Appeals denied Rosenberg a special permit to stay open last Thursday, giving him a week to close shop. The summer treat stand opened in May 2016. Supporters say they want Rosenberg to stay. "Stores are closing all over the place," says Bill Kopp, of Eastchester. "I see empty stores in every shopping center I go to. This was a ratty looking gas station before. Look what he's done to improve the area." And some parents are arguing that it's not a safety hazard at all -- the ice cream shop gives their kids a safe place to go after school, they say. MAMARONECK NEWSWIRE GETS RESULTS: After Mamaroneck Newswire reported that this village food establishment's health permit expired April 30 Westchester County took action. Officials with the county Health Department say they spoke with Rosenberg via phone Friday and are giving him a chance to shut down voluntarily. If he doesn't, he'll be issued a summons to appear at a county administrative hearing office. Health Department officials say they will be doing spot checks over the weekend to see if the store is still open. The Mamaroneck Police will also monitor the business following a violation issued by the Building Department. https://www.facebook.com/groups/747730981915736/permalink/1516791431676350/

Davis beat out three other candidates, including current Mayor Clinton Young, in a Democratic primary last month. City Comptroller Maureen Walker, who was also defeated in the primary by Davis, is now running on the Conservative Party line against him in the general election. Davis and the Democrats have branded Walker as a "Tea Party Conservative" while Walker says that Davis himself ran on the Conservative Party line four years ago for the same job.
